New Labour Law

 

        Thailand's new Labour Protection Act, B.E.2541 took effect on 19 August 1998.Since then there have been royal decree and ministerial regulations issued to exclude certain kinds of work from the general provision of the Law.However,sea men working in sea carriage businesses remain within the framework of the Labour Portection Act despite plans to exclude them from mainstream labour.Therefore,this paper attempts to provide a brief

summary of only important aspects of the law which also apply to crew members in the form of basic information as follows:-

 

1. Status of employee

 

        Under the new law,employees of contractors or sub-contractors are also regarded as employees of a business owner if they work in any part of production process or business activity of such business owner.

 

2. Transfer of employment :

 

        A new employer must accept the rights,duties and exployment conditions of the former employer.

 

3. Sick Leave :

 

        Employee can take a maximum sick leave with pay for 30 working days each year.

 

4. Severance pay :

 

        Employee whose employment is terminated without cause is entitled to severance pay as perthe following rates:

 

                   Period of service                             Severance Pay

                    120 days <1 Year                           30 day pay of the last wage

                    1 year <3 years                               90 day pay of the last wage

                    3 year <6 years                             180 day pay of the last wage

                    6 year <10 years                           240 day pay of the last wage

                    10 years and up                            300 day pay of the last wage

 

5. Employees Welfare Committee :

 

        Any employer with at least 50 employees has to set up an Employees Welfare Committee in accordance with officially prescribed procedures.
